Welcome to Mouz. By downloading, installing, or using the Mouz mobile application and related services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Mouz ("the Service," "the App," or "we"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our Service.

2. Description of Service

Mouz is an AI-powered interior design application that enables users to transform photos of interior and exterior spaces through various editing tools including:

• Style Presets: Apply complete design styles to rooms
• Furniture Placement: Add or replace furniture items
• Wall Paint: Change wall colors and textures
• Flooring: Modify floor materials and designs
• Roofing: Update exterior roofing styles
• Magic Erase: Remove unwanted objects from images
• Custom Prompts: Generate designs based on text descriptions

The Service supports over 40 room types and generates AI-powered visualizations of your design choices.

3. User Accounts

To use Mouz, you must create an account using one of the following methods:

• Apple Sign In
• Google Sign In
• Email and password

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Credits and Usage

Mouz operates on a credit-based system:

• Free Trial: New users receive a 24-hour trial period with limited credits to test the Service.
• Monthly Credits: Pro subscribers receive 150 credits per month, which reset at the beginning of each billing cycle.
• Lifetime Credits: Credits purchased through one-time add-on packs (50, 150, or 400 credits) never expire and remain available indefinitely.
• Credit Consumption: Each AI-powered generation consumes one or more credits depending on the complexity of the request.
• No Refunds for Used Credits: Credits that have been consumed for successful generations are non-refundable.

5. Subscriptions and Payments

5.1 Subscription Plans

Mouz offers a Monthly Pro subscription that provides:

• 150 credits per month
• Access to all editing tools and features
• High-resolution image exports
• Unlimited project storage
• Version history for all projects

5.2 Payment Processing

All payments are processed securely through third-party payment providers:

• iOS: Apple App Store (managed by Apple Inc.)
• Android: Google Play Store (managed by Google LLC)

Your payment information is never stored on our servers. All billing disputes should be directed to the respective app store.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You can manage your subscription and turn off auto-renewal in your app store account settings.

5.4 Refund Policy

Refunds are subject to the policies of the Apple App Store and Google Play Store. Generally:

• Subscription refunds must be requested through your app store account
• Credits that have been used for successful generations are non-refundable
• Unused lifetime credits remain in your account even after subscription cancellation

5.5 Purchase Restoration

You can restore your purchases on a new device by signing in with the same account and using the "Restore Purchases" feature in the app settings.

6. AI-Generated Content

6.1 Nature of AI Content

All design visualizations generated by Mouz are created using artificial intelligence and machine learning algorithms. These visualizations are approximations and artistic interpretations based on your input images and design choices.

6.2 No Guarantees

We do not guarantee that:

• AI-generated designs will be architecturally accurate or feasible
• Colors, materials, or furniture will match real-world products exactly
• Generated designs are suitable for actual construction or renovation
• Results will meet your specific expectations or requirements

6.3 Professional Advice

Mouz is an inspiration and visualization tool. For actual construction, renovation, or design implementation, you should consult with licensed professionals including architects, interior designers, contractors, and structural engineers.

6.4 Ownership of Generated Content

You retain ownership of the original photos you upload. AI-generated designs based on your photos are licensed to you for personal and commercial use, subject to these Terms.

7. User Content and Privacy

7.1 Your Photos

When you upload photos to Mouz:

• You grant us a limited license to process, store, and use your images solely for the purpose of providing the Service
• Your photos are stored securely in your private account on Firebase Cloud Storage
• We do not share your photos with third parties except as necessary to provide AI generation services
• We do not use your photos to train AI models or for any purpose other than providing the Service to you

7.2 Project Data

All projects, design history, and generated images are stored in your account. You can delete projects at any time, which will remove them from our servers.

7.3 Sharing

When you use the share feature, you are responsible for choosing where and with whom to share your designs. We do not control or monitor shared content.

8. Prohibited Uses

You agree not to use Mouz to:

• Upload images you do not have the right to use
• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to reverse engineer, decompile, or extract the AI models or algorithms
• Use automated systems (bots, scripts) to access the Service
• Resell or redistribute generated content as a competing service
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service to generate excessive requests in an attempt to abuse the credit system

9. Intellectual Property

9.1 Our Intellectual Property

Mouz, including its design, logo, app interface, features, and underlying technology, is owned by Mouz Inc. and protected by copyright, trademark, and other intellectual property laws.

9.2 Furniture Catalog

Images and descriptions in our furniture catalog are provided for reference purposes only. We do not claim ownership of furniture designs. Furniture recommendations are for inspiration and may not reflect current availability or exact specifications.

9.3 User License

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use Mouz for its intended purpose.

10. Service Availability

We strive to provide reliable service, but we do not guarantee that:

• The Service will be available at all times without interruption
• The Service will be error-free or bug-free
• All features will work on all devices or operating system versions
• AI generation requests will always succeed (failed requests do not consume credits)

We may perform maintenance, updates, or modifications that temporarily affect Service availability. We will make reasonable efforts to notify users of planned maintenance.

11. Termination

11.1 Termination by You

You may stop using the Service and delete your account at any time through the app settings. Upon account deletion:

• Your subscription will be canceled (subject to app store policies)
• Your projects and data will be deleted from our servers
• Unused lifetime credits will be forfeited
• You may not be eligible for refunds of unused subscription time

11.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or abusive behavior
• We are required to do so by law
• We discontinue the Service (with reasonable notice)

12. Disclaimers and Limitations of Liability

12.1 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOUZ INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
• Design decisions or construction/renovation outcomes based on AI-generated content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mouz Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Content you upload to the Service

14. Analytics and Monitoring

We use Firebase Analytics and Firebase Crashlytics to improve the Service:

• Analytics: We track app usage patterns, feature usage, and session duration to improve user experience
• Crashlytics: We automatically collect crash reports and error logs to identify and fix bugs
• All analytics data is anonymized and used solely for improving the Service

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify users through the app or via email
• Provide a reasonable notice period for material changes

Your continued use of the Service after changes become effective constitutes your acceptance of the modified Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mouz Inc. regarding the use of the Service and supersede all prior agreements and understandings.
